Above puppy is a pet quality puppy. The owner/buyer agrees to have the puppy examined by his/her licensed veterinarian within 72 business hours of purchase/arrival. If the veterinarian finds the puppy to have a medical problem or genetic defect the seller/breeder will give a full refund excluding shipping or travel expenses if any or exchange the puppy, whichever owner/buyer prefers upon return of the defective puppy. The seller/breeder reserves the right to issue a full refund if the seller/breeder feels a new puppy is in danger of contracting a communicable illness, disease or could be subject to any other conditions in which the seller/breeder is not comfortable. Owner/buyer is responsible for any costs when returning the puppy. Guarantee does not cover patella's, parasites or hypoglycemia. A Veterinarian thoroughly checks patella's before leaving.
After expiration of the 72-hours guarantee a one-year congenital health guarantee applies. Congenital means a defect that the above puppy was born with but has gone undetected. If puppy is found to have a congenital defect, owner/buyer agrees to contact Seller/breeder at once and have the puppy examined by a second Veterinarian chosen by the Seller/breeder expense.
If Two State licensed Veterinarians within different practices agree that the defect will greatly affect the puppy's quality of life or cause premature death, Seller/breeder will replace the puppy with one of equal quality, when on becomes available.
Defective puppy, signed veterinarian statement of congenital defect from Owner/buyer's Veterinarian and registration papers, including, but not limited to properly executed registration papers. Transfers and late fees, if any, required by issuing registry, must be returned to seller/breeder at owner/buyers expense before puppy will be replaced.
If the puppy expires due to the defect owner/buyer agrees to have defective puppy properly shipped back to seller/breeder for necropsy purposes. If a puppy does not become available within one year after the return of the puppy and required documentation seller/breeder will refund the purchase price of the puppy. Patella's are not covered under the one-year guarantee. There are NO exceptions to this guarantee.
Seller/breeder will not be responsible for any medical services performed by a veterinarian not authorized by the seller/breeder at any time.
A pet quality puppy will be capable as performing as a healthy pet.
This puppy has/will be examined by a licensed veterinarian and found to be free of defects and is current on all shots for his/her age. We strongly recommend you complete all shots needed to protect your puppy against sickness and disease. Please take the vaccination record with you on your well puppy check.
Seller/breeder has the right to first refusal if the owner/buyer cannot keep the puppy for any reason. If the seller/breeder does not wish to purchase the puppy, seller/breeder can assist in finding a suitable home. If owner/buyer must re-home puppy immediately owner/buyer will return puppy to seller/breeder at owner/buyers expense and seller/breeder will find a suitable home. It is agreed that the puppy will not be turned over to a shelter, rescue pound or other similar enterprise for any reason or excuse.
Buyer also certifies that they are not licensed as a USDA Licensee, nor are they acting on behalf of a Pet Shop. That the above mentioned puppy is being purchased for their own use and not for resale.
Owner/buyer and seller/breeder agree that the contract will be governed by the laws of the State of Texas and may not be altered, modified or rescinded unless agreed to by both parties in writing.
No other warranties or guarantees, expressed or implied are made under this contract except stated herein. We further agree that any claims that might arise from this sale will not exceed the purchase price of the puppy.
The deposit which is one half of the price of the puppy is non-refundable for any reason unless something happens to the puppy while the breeder still has possession.
Having read the contract, and with full understanding of the contents therein, I/We cheerfully enter into this agreement.
